Rentto Privacy Policy

1. Introduction

Welcome to our privacy policy. We respect your privacy and take the protection of personal information very seriously. We understand that your trust is our most important asset.

Rentto is owned and operated by Rentto Group (Pty) Ltd, registration number: 2026/397159/07.

To provide you with our full range of Rentto products and services we need to collect and process certain information about you. The purpose of this policy is to describe the way that we collect, store, use, and protect information that can be associated with you or another specific natural or juristic person and can be used to identify you (personal information).

This privacy policy must be read in conjunction with our Terms & Conditions.

2. Audience

This policy applies to you if you are:

  • a visitor to our website, mobile site, or applications ("apps");
  • a customer who has ordered a product or requested a service;
  • an estate agency making use of our services; or
  • anyone contacting us by phone, SMS, email, in letters and other correspondence, and in person.

3. Personal Information

Personal information includes: certain information collected automatically when you visit our website; information collected on registration; information collected on submission; and optional information you provide voluntarily.

It excludes information that has been made anonymous, permanently de-identified information, non-personal statistical information, and information voluntarily provided in an open public forum.

Common examples include: identifying information (first name and last name) and contact information (phone number and email address).

4. Acceptance

You acknowledge and accept all terms of this policy when accessing the website to order a product or request our services. You must be at least 18 years of age and have legal capacity to conclude legally binding contracts.

By accepting this policy, you are deemed to have read, understood, accepted, and agreed to be bound by all of its terms. You may only send us your own personal information, or the information of another data subject where you have their permission to do so.

5. Changes

We reserve the right to change the terms of this policy at any time. All changes will be posted on the website. If you do not agree with the changes, you must stop using the website and our products or services.

6. Collection

We generally collect and process your personal information for various purposes, including:

  • Products or services purposes – collecting orders or requests for and providing our products or services.
  • Marketing purposes – pursuing lawful related marketing activities.
  • Business purposes – business intelligence and analytics, product improvement, internal audit, accounting, and business planning.
  • Legal purposes – handling claims, complying with regulations, or pursuing good governance.

On registration, we collect your first name, surname, email address, telephone number, and password. When you place a listing, we collect your province, city, suburb, and street address. All payment transactions are processed securely through Paystack; we retain no record of your payment card details.

We may place small text files called 'cookies' on your device when you visit our website to enhance your experience. We may also use web analytics tools (heatmaps, screen recordings) to understand how users interact with our website; all data collected through these methods is de-identified and anonymised.

7. Disclosure

We may share your personal information with:

  • other companies within our group to provide joint content and services;
  • our products or services providers under contract who help with parts of our business operations;
  • third-party service providers for the 'Rentto Offers' service;
  • estate agents in our professional panel when you submit an enquiry;
  • regulators as required by law or governmental audit;
  • law enforcement where required for the prevention or detection of offences.

We will never sell your personal information for independent marketing purposes.

8. Security

All information we receive is stored on secure servers. We have implemented technical and organisational measures to protect your personal data against accidental or unlawful loss, access, or disclosure. Despite these measures, the transfer of data through the Internet is never completely secure, and there is a risk your personal data may be accessed by unauthorised third parties.

9. Retention

We will only retain your personal information for as long as it is necessary to fulfil the purposes set out in this policy, unless retention is required or authorised by law, or you have consented to the retention of the record.

10. Your Rights

You may choose to review, update, or remove the personal information you have submitted to us by accessing your account online, emailing us, or phoning us. We will request proof of identity before removing your information.

Refund and Cancellation Policy

1. Introduction

This Refund and Cancellation Policy governs payments made through our platform for property listing services, advertising services, subscription plans, promotional products, and related services. By making payment through the platform, you acknowledge and agree to this Policy.

2. Payment Processing

All payments are securely processed through Paystack or other approved payment service providers. Payment methods may include:

  • Credit Cards
  • Debit Cards
  • Bank Transfers
  • Recurring Subscription Billing
  • Other payment methods offered by Paystack

3. Once-Off Listing Fees

Fees paid for individual property listings, featured listings, promoted advertisements, or other once-off services are deemed earned immediately upon activation of the listing or commencement of the service.

Once a listing has been published or a promotional service has commenced, the fee is non-refundable. No refunds will be issued due to:

  • Sale or rental of the property after publication;
  • Removal of a listing by the advertiser;
  • Failure to receive enquiries;
  • Change of mind by the advertiser; or
  • Early termination of advertising by the advertiser.

4. Monthly Subscription Services

Subscribers may purchase recurring monthly plans that provide access to listing services and platform features. Subscriptions automatically renew at the end of each billing cycle unless cancelled before the next billing date. The subscriber authorises recurring charges through the selected payment method.

5. Cancellation of Subscriptions

Subscribers may cancel their subscription at any time through their account dashboard or by written notice to support. Upon cancellation:

  • Access to subscription features will continue until the end of the current paid billing period.
  • No partial or pro-rata refunds will be provided for unused portions of the billing cycle.
  • Future recurring payments will cease after the current billing period expires.

6. Failed Payments

Where a recurring payment fails, access to subscription services may be suspended and listings may be paused or removed. The company reserves the right to retry payment collection where permitted by law and Paystack's billing rules.

7. Refund Exceptions

Refunds may be considered in the following circumstances:

  • Duplicate payments;
  • Incorrect billing caused by a system error;
  • Fraudulent transactions verified by the payment provider;
  • Services that were paid for but could not be delivered due to a fault of the platform; or
  • Circumstances where a refund is required by applicable South African law.

Approved refunds will be processed to the original payment method where possible.

8. Consumer Rights

Nothing in this Policy limits or excludes any rights that consumers may have under:

  • The Consumer Protection Act 68 of 2008;
  • The Electronic Communications and Transactions Act 25 of 2002; or
  • Any other applicable South African consumer protection legislation.

Where South African law grants a consumer a right to cancellation or refund, those rights shall prevail over any conflicting provision in this Policy.

9. Chargebacks and Payment Disputes

Customers agree to contact us first to resolve any billing dispute before initiating a chargeback through their bank or card issuer. We reserve the right to suspend or terminate accounts associated with fraudulent or abusive chargeback activity.

10. Amendments

We may amend this Policy from time to time. Any changes will become effective upon publication on the website.

11. Governing Law

This Policy shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. Any dispute arising from or relating to this Policy shall be subject to the jurisdiction of the courts of South Africa.

The website is not involved in the buying, selling, or development of the property process and must not be considered to be an agent, buyer, and/or a developer with respect to the use of the website.

Rentto shall not be responsible for any user entering into agreements or making decisions in connection with the posting of property ads, property information, the use of financial calculators, and/or any other information obtained on the website.

In no event shall Rentto be liable for any costs, expenses, losses, and damages of any nature (whether direct, indirect, punitive, incidental, special, or consequential) arising out of or in any way connected with your use of the website or the operational failure of the website.

Property Listing Service

Rentto is not, and does not hold itself out to be, an estate agent as defined in the Estate Agency Affairs Act, 1976, or an attorney, conveyancer, financial or tax advisor, mortgage bond originator, or valuer. Rentto has no power as agent or otherwise to negotiate or conclude any agreement on your behalf.

When using the Listing Service you may not submit any material that is unlawful, harmful to minors, fraudulent, false or misleading, infringes any third party rights, or is defamatory or obscene. You are solely responsible for all material that you submit.

You grant Rentto a perpetual, royalty-free, transferable right to publish all material submitted by you. You must comply with all applicable laws, including the Consumer Protection Act, 2008 and the Alienation of Land Act, 1981.

Tenant Screening Service

The Tenant Screening Service is an optional credit, ID, and payment-history screening service. By opting into this service, you agree to the collection and processing of your special personal information (including ID numbers, credit data, and payment history) by both Rentto and its business partners in terms of relevant data protection laws.

Applicable Law

This website is hosted, controlled, and managed in the Republic of South Africa, and thus, South African law and jurisdiction govern the use or inability to use this website, or any other matter related to this website.

Disputes

All disputes in terms of this agreement shall be settled by arbitration conducted in English in terms of the rules of the South African Arbitration Foundation. Such arbitration shall be held in Cape Town, and the unsuccessful party shall pay all costs incurred by the successful party.

Responsible Advertising Code

Rentto commits to adhering to ethical and responsible advertising principles. We will take the necessary steps to ensure any suspected hateful speech, incorrect information, and discrimination of any kind be investigated and removed when appropriate.
